Welcome to Infinite Marketing. These Terms of Service (“Terms”) govern your purchase and use of services provided by Infinite Marketing (“Infinite Marketing,” “we,” “us,” or “our”).

By purchasing services, signing a proposal or agreement, submitting payment, or otherwise authorizing Infinite Marketing to begin work, you acknowledge that you have read, understood, and agreed to these Terms.

1. Services

Infinite Marketing provides digital marketing and technology services that may include:

The specific scope, price, timeline, and deliverables for a project may be further defined in a proposal, invoice, statement of work, service agreement, or other written communication between Infinite Marketing and the client.

If a project-specific agreement conflicts with these Terms, the project-specific agreement will control to the extent of that conflict.

2. Client Responsibilities

Clients are responsible for providing the information, content, approvals, credentials, images, access, and other materials reasonably necessary to complete the agreed services.

Project schedules may be delayed when requested materials, feedback, approvals, access, or payments are not provided on time.

The client represents that it has the necessary rights and permissions to provide any content, trademarks, photographs, data, credentials, or other materials supplied to Infinite Marketing.

3. Payments

Payment terms will be stated on the applicable proposal, invoice, subscription, or service agreement.

Depending on the service, Infinite Marketing may require:

Failure to make required payments may result in suspension or termination of services.

4. Refund Policy

Because Infinite Marketing provides customized professional and digital services involving labor, strategy, research, planning, development, creative work, software configuration, and reserved production time, payments generally become non-refundable once work has begun.

Deposits and Initial Payments

Unless otherwise stated in writing, deposits and initial payments become non-refundable once Infinite Marketing begins work on the project.

Work may include, but is not limited to, discovery, consultation, research, competitive analysis, strategy development, project setup, design, development, content preparation, account configuration, SEO analysis, keyword research, or other project-related activities.

Completed Work

No refund will be issued for work or services that have already been performed, completed, delivered, implemented, or made available to the client.

SEO and Digital Marketing Services

Payments for SEO, local SEO, content marketing, PPC management, digital marketing, and similar ongoing services are non-refundable for service periods in which work has already begun or been performed.

Search engines, advertising platforms, social networks, directories, AI platforms, and other third-party systems are outside Infinite Marketing’s control. Therefore, Infinite Marketing does not guarantee specific rankings, traffic levels, lead volume, sales, revenue, advertising results, or other particular outcomes.

Website Design and Development

Payments for website design, development, Shopify development, application development, graphic design, and other custom production work are non-refundable to the extent that work has already been performed.

If a client cancels a project before completion, the client remains responsible for payment for work completed and expenses incurred through the effective date of cancellation, subject to the applicable proposal or service agreement.

Recurring Services

Cancellation of a recurring service stops future renewals in accordance with the cancellation terms applicable to that service. Cancellation does not automatically create a right to a refund for the current billing period or for work already performed.

Unless otherwise agreed in writing, clients should submit cancellation requests before their next scheduled billing date.

Third-Party Costs

Payments made for third-party products or services are non-refundable by Infinite Marketing once those charges have been incurred.

Examples may include:

Refund eligibility for third-party purchases may be subject to the third party’s own terms and refund policies.

Duplicate or Incorrect Charges

If you believe you were charged twice or charged an incorrect amount, contact Infinite Marketing promptly so the transaction can be investigated and, where appropriate, corrected.

5. Cancellation

Clients may request cancellation by contacting Infinite Marketing through an authorized business communication channel.

Cancellation does not eliminate amounts already owed for services performed, approved expenses, third-party charges, or other obligations incurred before the cancellation became effective.

Any project-specific cancellation requirements contained in a signed agreement, proposal, or statement of work will also apply.

6. Project Delays and Client Inactivity

If a project is delayed because the client does not provide requested information, approvals, content, credentials, or feedback, Infinite Marketing may adjust the delivery schedule.

Extended client inactivity may result in the project being paused, rescheduled, or closed. Payments for work already performed remain subject to the refund provisions above.

7. Revisions and Scope Changes

The number of revisions included in a project will be determined by the applicable proposal or agreement.

Requests outside the agreed project scope may require additional fees and may affect the completion schedule.

Infinite Marketing will notify the client when a request is considered outside the original scope whenever reasonably practicable.

8. No Guarantee of SEO or Marketing Results

Infinite Marketing uses professional strategies intended to improve clients’ digital presence and marketing performance. However, no specific result is guaranteed.

Google and other platforms independently determine rankings, visibility, account eligibility, advertising performance, algorithm changes, and other platform outcomes.

Accordingly, Infinite Marketing cannot guarantee:

Statements regarding strategies, projections, opportunities, or expected performance should not be interpreted as guarantees.

9. Third-Party Platforms

Some services depend on third-party platforms, including search engines, hosting providers, advertising networks, social platforms, e-commerce platforms, software providers, and AI services.

Infinite Marketing is not responsible for outages, policy changes, algorithm updates, suspensions, restrictions, data loss, pricing changes, or other actions caused by third-party platforms outside our reasonable control.

10. Intellectual Property

Unless otherwise specified in writing, Infinite Marketing retains ownership of its pre-existing tools, processes, methodologies, templates, software, know-how, and other intellectual property.

Ownership or licensing rights for final client-specific deliverables will be governed by the applicable proposal or agreement and may be conditioned upon full payment of all amounts due.

Third-party assets remain subject to their respective licenses.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Infinite Marketing will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of our services.

Any additional limitations of liability contained in a project-specific agreement will also apply.

Nothing in these Terms is intended to exclude or restrict liability that cannot legally be excluded or restricted.

12. Chargebacks and Billing Disputes

Clients should contact Infinite Marketing promptly if they believe a billing error has occurred so we have an opportunity to investigate and address the issue.

Initiating a payment dispute or chargeback does not automatically eliminate amounts legitimately owed under an applicable agreement or for services already rendered.

Nothing in these Terms limits any rights a consumer or client may have under applicable law or payment-network rules.

13. Termination

Infinite Marketing may suspend or terminate services for material breach of these Terms or an applicable service agreement, including nonpayment, unlawful use of services, abusive conduct, or failure to provide information reasonably necessary to perform the services.

Where appropriate, Infinite Marketing may provide notice and an opportunity to correct the issue before termination.

14. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

15. Changes to These Terms

Infinite Marketing may update these Terms periodically. The current version will be posted on our website with its effective or last-updated date.

Changes will apply prospectively except where otherwise permitted or required by law or an applicable agreement.
